About The Role

Horwich Farrelly’s costs department is a recognised market leader in third party costs legal cost negotiation.  The team deal with costs ranging from fixed fees in MoJ portal cases right through to £multi-million large loss cases for insurers, self-insureds and other organisations.  The team handle all types of work, both as receiving and paying parties.

 

It is an exciting time to join the costs team as the department continues to transform under newly appointed Partner Paul McCarthy’s leadership. Paul has ambitious plans to grow the costs department and is joined by his highly experienced team. Known as experts in their field the team have extensive experience in both defendant and claimant cost negotiation and advocacy. The Role

There are a number of roles available focussing on key areas including costs management, fixed costs, paying party and receiving party costs work.  Dependent on experience the role will involve a mix of work in the following areas:-

Costs Management: drafting budgets, and challenging opponents’ budgets, subsequent negotiations and attending CCMCs where appropriate.

Fixed Costs: considering and challenging claims for fixed costs and associated disbursements to include handling negotiations, drafting Points of Dispute and managing Part 8 proceedings

Paying party: negotiating settlement of third party costs claims, drafting Points of Dispute and managing procedural issues as appropriate.

Receiving party: drafting N260’s and bills of costs (to include E-bills), handling negotiations, drafting Replies and managing procedural issues as appropriate.

 

Successful candidates will be expected to work collaboratively with client and the substantive case handler to ensure the best possible outcome.  The case load is also likely to include some paying party costs negotiation work and/or costs recovery work dependent on experience.  The work will cover a variety of claims for costs including a mixture of personal injury claims including motor, casualty and catastrophic injury.

 

Main Responsibilities:

  • To run and manage a caseload of costs files including drafting and negotiating budgets and preparation/consideration of associated documents, drafting and consideration of bills including e-bills and summary of costs statements, drafting of points of dispute and general costs negotiations, advising clients.
  • To ensure that all cases are dealt with in compliance with Solicitors’ Accounts Rules and Law Society Practice Management Standards.
  • To ensure effective case management, compliance with internal and external service standard requirements.
  • To ensure the production of high quality work on own files and any other files where assistance or cover is provided.
  • To attend court on costs hearings.
  • To liaise with clients as appropriate.
  • To assist partners and senior fee earners with complex cases.

Personal Specification

The successful candidate will have:

  • Previous experience in 1 or more key area (costs management, fixed costs, paying party & receiving party)
  • Previous experience of costs negotiation dealing with costs recovery and / or adverse costs
  • Be proficient in handling a full lifecycle of costs matters.
  • Client-centric approach and excellent client care
  • Have strong organisation skills and an ability to consistently meet deadlines.
  • Have excellent technical and analytical skills with a detail-orientated approach.
  • Have well-developed negotiation skills.
  • Be experienced and proficient in the use of case management systems.
  • Have the ability to work to tight deadlines.
  • Be an excellent communicator and enjoy building relationships whilst providing clear and concise advice.
  • Wish to learn new skills and acquire technical expertise.
  • Work well as part of a team and under their own initiative.
  • Not be afraid to question and challenge information and evidence put forward by the parties (and their representatives) in a case.
  • Have a commercial awareness to legal issues.
  • Be flexible with a positive attitude to change, both internally and in the context of clients' business
